AMCSI Membership Contract

This Membership Contract (“Contract”) is entered into by and between AMCSI (“Company”), located at 7365 Carnelian Ste #104, Rancho Cucamonga, CA 91730, and the undersigned individual (“Member” or “Subscriber”). By signing this Contract, the Member agrees to the terms outlined below, effective upon execution of this document.

1. Services Provided

AMCSI offers mental health services under a subscription-based membership. The services provided depend on the level of subscription selected by the Member:

• Gold: Includes a weekly therapy session (individual, couple, or family) for one member.
• Platinum: Includes all Gold benefits for the member plus one additional person (such as an elderly parent, a spouse, or a dependent child) and psychological testing for both.
• Diamond: Includes all Platinum benefits for the member plus three additional people and access to all classes/groups.
• Enterprise: Includes a weekly therapy session (individual, couple, or family), and access to a group/class.

2. Subscription Plans and Fees

• Gold: $55/month or $420/year for one member.
• Platinum: $80/month or $780/year for one member plus one additional person.
• Diamond: $170/month or $1260/year for one member plus three additional people.
• Enterprise: $20 per employee, with a minimum of 15 employees. Employees pay a $5 co-pay per session, and each additional family member is covered at $10 per month, paid by the company.

3. Payment Terms

Membership fees are due on or before the start of each renewal period (monthly or yearly) and will auto-renew (by credit card or EFT) on the first of each renewal period unless canceled by either party with 30 days’ notice.

• Late Payments: An $8 late fee applies if payment is not received by 11:59 PM PST on the third day after the due date. If payment is more than 90 days late, re-registration as a new member is required.
• Additional service charges (e.g., progress reports, duplicate certificates) are billed immediately via EFT or credit card.
• All payment disputes must be submitted in writing within 120 days of the disputed charge.

4. Cancellation Policy

Members may cancel their subscription with 30 days’ written notice. Memberships will auto-renew unless canceled. No refunds will be provided for full payments, including prepaid annual memberships.

5. Cancellation by AMCSI

AMCSI reserves the right to cancel a membership at its discretion for reasons such as non-payment, breach of this Contract, or inappropriate behavior. In such cases, no refund will be provided.

6. Collections

If fees remain unpaid for more than 90 days, AMCSI may seek payment through a third-party collection agency. The Member is responsible for any additional costs incurred in collecting the debt.

7. Subscriber Responsibility

The Member is responsible for ensuring the accuracy of all personal information and making timely payments. The Member agrees to notify AMCSI promptly of any changes to their contact or billing information. The Member acknowledges the potential risks involved in wellness activities and agrees to hold the Company harmless from any claims or injuries arising from participation in the Services.

8. Confidentiality

AMCSI is committed to maintaining the confidentiality of the Member’s information in accordance with HIPAA guidelines. No personal or health information will be disclosed without the Member’s written consent, except as required by law.

9. Governing Law and Legal Action

This Contract shall be governed by the laws of the State of California. Any legal action or proceeding related to this Contract shall be brought exclusively in the courts of San Bernardino County, California.

10. HIPAA Compliance

AMCSI complies with all HIPAA regulations to ensure the confidentiality and security of all health-related information.

This Contract constitutes the entire agreement between AMCSI and the Member, superseding all prior agreements or understandings, whether written or oral.

13. Amendments

AMCSI reserves the right to amend this Contract at any time. Any changes will be communicated to the Member with 30 days’ notice.
